These Terms of Use ("Terms") govern your access to and use of agents.ezmate.ai (the "Site"), operated by EZmate AI ("EZmate", "we", "us", "our"), Perth, Western Australia. By accessing the Site or booking a call through it, you agree to these Terms. If you do not agree, do not use the Site.

1. Who this Site is for

The Site is intended for licensed real estate agents, sales representatives, and real estate agencies operating in Australia. It is a business-to-business marketing and scheduling page. It is not directed at consumers or property owners seeking to buy or sell property.

2. What the Site does

The Site provides information about EZmate's listing appraisal appointment-setting service and allows you to book a strategy call with us. Booking a call does not create a client relationship or any obligation on either party to proceed. Any services we provide are governed by a separate written Service Agreement signed by both parties.

3. No guarantee on this Site

Figures, examples, and results shown on the Site are illustrative. They describe how our system is designed to work and what results may be possible. They are not a guarantee of any specific number of leads, appointments, appraisals, listings, or commission income. Any guarantee we offer is set out only in a signed Service Agreement, including its conditions and definitions.

4. Booking a call

When you book a call you agree to provide accurate contact details and to attend at the scheduled time or cancel with reasonable notice. We may decline or cancel a booking at our discretion, including where your location, business type, or volume does not fit our service.

5. Communications and consent

By submitting your details through the Site you consent to EZmate contacting you by phone, SMS, and email about your enquiry and our services, in accordance with the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth). You can withdraw consent at any time by replying STOP to any SMS, clicking unsubscribe in any email, or emailing us at [email protected].

6. Privacy

We collect and handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy explains what we collect, why, and how you can access or correct it. By using the Site you agree to our Privacy Policy.

7. Intellectual property

All content on the Site, including text, graphics, logos, diagrams, system descriptions, and the EZmate name and logo, is owned by or licensed to EZmate. You may view the Site for your own business evaluation. You may not copy, reproduce, scrape, or use any content for commercial purposes without our written permission.

8. Acceptable use

You must not use the Site to submit false information, book calls you do not intend to attend, attempt to access systems or data not intended for you, or interfere with the operation of the Site or its scheduling tools.

9. Third-party platforms

The Site is not part of the Facebook or Instagram websites and is not endorsed by Meta Platforms, Inc. in any way. Facebook and Instagram are trademarks of Meta Platforms, Inc. The Site may use third-party scheduling, analytics, and communication tools. We are not responsible for the availability or conduct of those third parties.

10. Liability

To the extent permitted by law, EZmate is not liable for any loss, damage, or cost arising from your use of the Site or reliance on its content, including lost income, lost listings, or lost commission. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

11. Changes

We may update these Terms at any time by posting a revised version on the Site. Continued use of the Site after changes are posted means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws of Western Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia.
